GENERAL TERMS AND CONDITIONS OF SALE
1. General
The general terms and conditions of sale described below apply to all products and services sold solely through the Cocooning Nature SA E-Commerce site. They define the rights and obligations of the parties.
Cocooning Nature SA reserves the right to modify at any time the content and form of these terms and conditions.

2. Products
The products visible on the E-commerce site and the stock status of the product displayed in real time on the site are purely indicative and do not constitute offers from Cocooning Nature SA.
Cocooning Nature SA undertakes to make every effort to ensure that the photographic representation of the products and services offered for sale on the E-Commerce site is as faithful as possible to reality. However, due to the way these products are presented on the Internet, it is possible that the Customer's perception of the photographic representation of the products does not correspond exactly to the products themselves.
3. Personal Data
Cocooning Nature SA undertakes to respect the confidentiality of the personal data communicated by the Customers on the E-Commerce site and to process them in accordance with legal obligations.
Cocooning Nature will only pass on personal data to third parties insofar as they are essential for the proper execution of the Order.
No data will be passed on to third parties for commercial purposes.
The Client's data may be used by Cocooning Nature SA's internal services:
- To process orders, deliveries and invoices
- To obtain your opinion in order to improve our products and services
The customer has the possibility to refuse the sending of invitation or commercial communication emails by Cocooning Nature SA, at the time of his first registration. This feature can be modified at any time by unsubscribing from the newsletter.
The Customer undertakes to provide the personal information necessary for the management of his/her order (delivery and billing). This information must be correct, valid and up to date. The information relating to his identification and his password must be kept secret by the customer.
4. Sales process
4.1. Orders
Once the desired product is selected, it is placed in the "shopping cart" by clicking the "Add to cart" button. The customer can then continue his selection of items, modify his shopping cart or continue the order process and pay.
Validation of the order by the customer constitutes acceptance of the general terms and conditions of sale.
Once the order has been validated and paid for, the customer receives an order confirmation by email.
4.2. Prices
The prices mentioned for each article on the E-Commerce site are indicated inclusive of all taxes and exclusive of preparation or logistical delivery costs. The shipping costs of the order will be indicated before the final validation of the order.
Cocooning Nature SA reserves the right to modify without notice and at any time the prices and other charges displayed on the E-Commerce site. However, the Products will be invoiced to the Customer on the basis of the prices in force at the time of validation of the order.
4.3. Representation of the Products
Cocooning Nature SA undertakes to make every effort to ensure that the photographic representation of the products and services offered for sale on the E-Commerce site is as faithful as possible to reality. However, due to the way these products are presented on the Internet, it is possible that the Customer's perception of the photographic representation of the products does not correspond exactly to the products themselves.
4.4. Secure payments
For the payment of the order, the following are accepted:
- Visa
- Mastercard
- Postfinance
- Invoice (through SwissBilling)
The payment of purchases is made on the secure bank or postal servers of Cocooning Nature SA's partners, as mentioned above. This implies that no banking or postal information concerning the Customer passes through the Cocooning Nature SA sites. Payment by bank or postal card is therefore perfectly secure.
The order shall be recorded and validated as soon as the payment is accepted by the payment system chosen by the Customer. The Customer's Order will be validated and the Customer's card will be automatically debited at the time the Order is registered.
The Customer must complete the registration form offered on the Web Site before placing an Order. The Customer's credit card or Postcard details are encrypted using SSL (Secure Socket Layer) protocol and are never transmitted unencrypted over the network. Payment of the advance is made directly to the bank or post office. The card number is not sent to Cocooning Nature SA.
PAYMENT ON INVOICE at 30 days in partnership with swissbilling. swissbilling SA is a service that allows you to pay your order by invoice in a simple and secure way. The invoice will be sent to you by swissbilling separately from the parcel, by e-mail or by post, depending on your choice. swissbilling services entail additional billing costs. The maximum amount for a first purchase with swissbilling is CHF 300.00. The payment term is 30 days from receipt of the invoice. For security reasons, the billing address and the delivery address must be identical. Before accepting your order, swissbilling AG reserves the right to check your creditworthiness with the CRIF AG database in Zurich (Tel.: 044 913 50 50, www.crif.ch).The minimum order value on the website is Sfr. 40.00, including VAT, excluding shipping costs.
4.6. Delivery
The delivery costs are calculated at the end of the order, according to the weight, the volume and the rates of the carrier in charge of the delivery. The Customer is responsible for shipping costs if the amount of products selected in the order is less than CHF 95 in Switzerland, and will therefore be charged CHF 7.50 for Switzerland.
Cocooning Nature SA ensures the shipment of goods sold through the E-Commerce site in Switzerland. The products and/or services will be sent to the delivery address indicated by the Customer during the ordering process.
From the moment of the order and the confirmation of the payment, the delivery times, given as an indication, are the following:
- 3 to 5 working days for Switzerland
In the event of a temporary stock shortage, Cocooning Nature SA undertakes to deliver the missing item as soon as possible or to propose a replacement solution.
4.8. Returns, withdrawal and refund
From the moment the Customer receives the product, he/she has a right of withdrawal, i.e. a period of 14 days to return the delivered product, the return costs being at his/her expense. Only products purchased through the E-Commerce site, and returned with their film or individual protective packaging intact (unopened and in their original packaging) will be eligible for a refund.
The procedure to follow is as follows:

The product must be complete, correctly protected, in its original packaging, with the film or individual protective packaging intact (unopened), accompanied by all possible accessories.
The product must be accompanied by :
- The order number
- The name of the person returning the order
The product is checked by Cocooning Nature's internal services who will validate or not the refund, in particular by verifying that the product has been returned complete and in a condition suitable for its re-marketing, as the right of withdrawal provides.
If the goods meet the return requirements, they can be refunded or exchanged.
If the goods do not meet the return requirements, they will be sent back to the customer who will not be entitled to a refund.
5. Applicable law
These general terms and conditions of sale, as well as any sale to which they apply, are subject to Swiss law. Any dispute arising out of or in connection with these terms and conditions of sale or any sale to which they apply shall be governed by Swiss law, whether such dispute is in contract or tort, or is based on any other provision. The application of the 1980 United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. The exclusive place of jurisdiction is Lausanne.
6. Original text
The General Terms and Conditions of Cocooning Nature SA are written in French and German. In the event of contradiction, the French version shall prevail.
